1. Heard Sri Jai Pratap Singh, learned counsel for the petitioner and learned A.G.A. for the State.

2. Learned A.G.A. on the basis of instructions submits that since the charge-sheet was filed by the local police and thereafter the investigation was transferred to the Special Investigation Team(SIT) formed by the State government, there was no occasion for the local police to conduct further investigation in regard to two accused who were not traceable at the time of filing the charge-sheet, therefore, no report was filed in regard to them. He further submits that SIT, after making investigation in compliance of the impugned order passed by the State government, had filed a final report. The said final report has been rejected by the trial court by means of the order dated 8.3.2021 passed in criminal case no. 467 of 2019. There is no occasion for the SIT to proceed in the matter and now remedy before the petitioner is to approach to the trial court under Section 319 Cr.P.C., if he wants them to be summoned.

3. Faced with the above, learned counsel for the petitioner submits that the petion may be disposed of in terms of the statement of learned A.G.A. so that he may avail the remedy before the trial court under the Versus Counsel for Petitioner(s) : Jai Pratap Singh Counsel for Respondent(s) : G.A., Anil Kumar Yadav Jai Karan Singh .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Home Lucknow And Ors. .....Respondent(s)

criminal procedure code.

4. In view of the above, the petition is disposed of in terms of statement of learned A.G.A. with liberty as aforesaid. December 11, 2025 kanhaiya CRLP No. 17968 of 2020 2 (Zafeer Ahmad,J.)
