HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW CRIMINAL APPEAL No. - 3702 of 2025 Court No. - 28 HON'BLE PRAMOD KUMAR SRIVASTAVA, J. Sri Abhishek Mishra, Advocate has filed his Vakalatnama today in Court on behalf of respondent Nos. 2 and 3. The same is taken on record. The present criminal appeal under Section 14-A (2) Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act has been preferred against the impugned order dated 10.10.2025 passed by the court of Special Judge, SC/ST Act, Lucknow in Second Bail Application No.7695 of 2025: Jitendra Shukla Alias Lallu Vs. State of U.P., arising out of Case Crime No. 158/2019, under Sections 302 I.P.C. and Section 3(2) 5 of SC/ST Act, Police Station Aminabad, District Lucknow, whereby the second bail application of the appellant has been rejected for want of prosecution. Learned A.G.A. has pointed out that the impugned order is an interlocutory order and has not been passed on merits. He further submits that Section 14-A(2) provides a statutory right of appeal only against orders granting or refusing bail and interlocutory orders are not application under Section 14A of the SC/ST Act, thus the instant appeal is not maintainable. At this stage, learned counsel for the appellant submits that he does not want to press this appeal and the same may be dismissed Versus Counsel for Appellant(s) : Shivam Gupta, Shishir Kumar Saxena Counsel for Respondent(s) : C.S.C., Abhishek Misra Jitendra Shukla Alias Lallu .....Appellant(s) State Of U.P.
