1. Heard learned counsel for petitioner, learned State Counsel appearing on behalf of the opposite parties 1 and 4 and Dr. Ravi Mishra, learned counsel for opposite parties 2 and 3.
2. Present petition under Article 226 of Constitution of India has been filed seeking a direction to opposite parties to refund tax deducted at source for Assessment year 2010-11 amounting to Rs.26,118/- and Assessment year 2011-12 amounting to Rs.22,812/-.
3. It has been submitted that determination with regard to aforesaid Return and Tax Deducted at source has already been made in terms of Section 143 of the Income Tax Act and therefore petitioner is entitled for aforesaid refund.
4. Since considering petitioner's grievance would entail factual aspects, liberty is granted to petitioner to file fresh representation before authority concerned. In case such a representation is filed, the same is required to be decided by authority concerned expeditiously by a reasoned and speaking order within a period of eight weeks from receipt of representation of petitioner along with a certified copy of this order.
