1. This is an application filed by the applicant/respondent no.3 for condonation of delay in filing the recall application.

2. Cause shown in the affidavit for filing the delay condonation application is sufficient.

3. The delay condonation application is allowed and the delay in filing the recall application is condoned. Ref: CM Application No.IA/3/25

4. Sri Mahesh Kumar Yadav, learned counsel for respondent no.3-United India Insurance Company Ltd. has pressed the application for recall of the order dated 25.06.2025.

5. It has been submitted by learned counsel for the petitioner that the present writ petition was filed seeking compensation under the Uttar Pradesh Mukhyamantri Sarvhit Kisan Bima Yojana. It was alleged that husband of the petitioner, namely, Ram Lakhan, had died who was the sole bread earner of the family and was fully covered under the Uttar Pradesh Mukhyamantri Sarvhit Kisan Bima Yojana and considering the contention of the Versus Counsel for Petitioner(s) : Vivek Chandra Counsel for Respondent(s) : C.S.C., Anil Kumar Srivastava, Mahesh Kumar Yadav Manju .....Petitioner(s) State Of U.P. Thru. Prin. Secy. Revenue Deptt. Lko. And 2 Others .....Respondent(s)

petitioner, the petition was disposed of by means of order dated 25.06.2025 directing the respondent no.3 to pay the amount within a period of four weeks.

6. It has been submitted by learned counsel for the applicant/respondent no.3 that in fact the claim of the petitioner already stood allowed and the payment had already been disbursed by online payment method on 27.02.2020 and the amount of Rs.5,00,000/- was credited to the account of Manju Lata (petitioner). In support of his submission, the claim disbursement form has been annexed indicating the said payment through the banking channels.

7. Despite the copy of this petition having been given much in advance to the petitioner, he submits that he does not have any instruction in the matter.

8. Considering the documents/evidence placed on record in the recall application, this court is of the considered view that once the payment under the Uttar Pradesh Mukhyamantri Sarvhit Kisan Bima Yojana had already been disbursed and the said fact was concealed by the petitioner then he was certainly not entitled to obtain direction as passed by its Court vide order dated 25.06.2025. Therefore, it is in the aforesaid circumstances, especially considering the fact that petitioner had already obtained the benefit of the amount to which she is entitled under the Uttar Pradesh Mukhyamantri Sarvhit Kisan Bima Yojana, no such direction could have been passed by this court.

9. Accordingly, the order dated 25.06.2025 is recalled. The recall application is allowed. Order on Writ Petition

10. Considering the fact that the petitioner has already been granted the benefit of the Uttar Pradesh Mukhyamantri Sarvhit Kisan Bima Yojana and the amount to which she is entitled has already been disbursed, no such claim can be considered again for the WRIC No. 6043 of 2025

death of the husband of the petitioner.

11. In light of the above, writ petition is dismissed. December 4, 2025 S.C. WRIC No. 6043 of 2025
