1. Case called out. None is present for the petitioner to press the petition, whereas learned AGA is present.
2. On the last date also, none had appeared on behalf of the petitioner to press the petition.
3. This Court had passed the following order on 21.02.2024:- "Supplementary affidavit filed today is taken on record. Heard. By means of this petition, the petitioner has sought quashing of F.I.R. dated 18.12.2021, bearing Case Crime/FIR No.0409/2021, for the offence under Sections 419, 420, 467, 468, 471 & 120-B I.P.C., registered at Police Station Wazirganj, District - Lucknow. Contention of petitioner's counsel is that the petitioner is a subsequent purchaser, based on a sale deed executed by Shirin Thomos, in 2020, therefore, he has no role to play in the alleged fabrication of the deed of 2000, allegedly by Shirin Thomos. Moreover, the informant has already initiated civil proceedings against the accused Shirin Thomos, her step mother, bearing Case No.1705/2016. Therefore, prima facie, case for interference is made out in favour of the petitioner. Let notice be issued to opposite party No.4. Let the pleadings be exchanged within eight weeks. List thereafter. Considering the submission made, it is provided that the petitioner shall not be arrested on the basis of the impugned First Information Report, unless and until there is sufficient and cogent evidence available against him regarding commission of the offence. He shall get his statement recorded before the Police as Versus Counsel for Petitioner(s) : Mohd. Imran Khan, Syed Mohd. Kashif Counsel for Respondent(s) : G.A. Mohammad Salman Kuraishi .....Petitioner(s) State Of U.P. Thru. Secy. Deptt. Of Home Civil Sectt. Lko. And Others .....Respondent(s)
and when he is called. If he does not do so, then it can be made a ground for seeking vacation of this interim order. "

Learned AGA, on the basis of instructions dated 15.11.2025 received from Prashant Singh, Sub Inspector, Police Station Wazeerganj, District Lucknow, which has been placed before this Court and taken on record, submits that charge sheet dated 10.07.2025 has been forwarded in the matter against the petitioner also. However, none is present to controvert the same.
5. In view of above, since after investigation, on the basis of evidence and material collected during investigation, prima facie, allegations have been found proved against the petitioner and charge sheet has been forwarded by the Investigating Officer, in regard to which, petitioner has an appropriate remedy before the concerned authority/ court, this Court is of the view that no purpose would be served by keeping this petition pending, when none is appearing to press the petition.
