1. Heard Sri Rahul Kumar Shukla, learned counsel for petitioners as well as learned Standing Counsel for respondent Nos. 1 to 4.
2. In light of the proposed order, notice to respondent No. 6 is dispensed with.
3. It has been submitted by learned counsel for petitioners that the petitioners are villagers and permanent resident of Village Ranjeet Nagar, Khargoopur, Pargana, Tehsil & District - Gonda and the private respondents are alleged to have encroached upon the gaon sabha land situated at Gata No. 458 area 0.121 hectare which is recorded as Khalihan as well as Gata No. 450 area 0.1500 hect which is recorded as Talab. He has submitted that petitioners have given various complaints to the State- respondents but no action has been taken and accordingly have moved this Court seeking a direction to the State respondents to initiate action against private respondents as per provisions of U.P. Revenue Code, 2006.

Learned Standing Counsel on the basis of written instructions received from Sub-Divisional Magistrate., Sadar, Gonda, which is taken on record has submitted that on receipt of the present writ petition, a report was sought from the Regional Lekhpal who has submitted his report on 11.11.2025, according to which in Gata No. 458 which is recorded as Versus Counsel for Petitioner(s) : Rahul Kumar Shukla, Mohit Singh, Shivam Srivastava, Umakant Yadav Counsel for Respondent(s) : C.S.C., Pankaj Gupta Sahaj Ram And Another .....Petitioner(s) State Of U.P Thru. Prin. Secy., Deptt. Of Revenue, Lko. And Others .....Respondent(s)
Khalihan certain persons were found to be in illegal possession and also the same position was with regard to Gata No. 450 which is recorded as a Talab and the police and the revenue teams have taken over the possession on the said land and evicted the encroachers from the said lands. It has been stated that encroachers were previously also evicted and they had again encroached upon the said land and subsequently also they have been evicted.
5. In light of the written instructions received from SDM, Sadar, Gonda, no further directions as prayed by the petitioners are required to be issued.
6. Accordingly, the writ petition is consigned to record. However, in case the petitioners find that encroachers have again encroached upon the said land, liberty is granted to them to move an appropriate application U/S 67 of U.P.
