**BEFORE CENTRAL GOVERNMENT INDUSTRIAL TRIBUNAL CUM LABOUR COURT, No. 2 DELHI;**
**Appeal no. D-2/09/2023**
M/s. Oravel Stays Limited
Appellant
Through:- Sh. Anil Bhatt, ld. counsel for the appellant
Vs.
APFC/RPFC, Gurugram East
Respondent
Through:- Sh. B. B. Pradhan, ld. counsel & Sh. Vishnu Bharadwaj, A/R for the respondent **Order Dated:-01.10.2024**
Ld. counsel for respondent has produced one pendrive of green colour submitting that the same has been given by Sh. Dinesh, the inquiry officer, to the department and he has brought the same.
It is very much surprising that the inquiry officer has taken the record of the case within i.e. the data given by the establishment in pendrive.
At this, Sh. Vishnu Bharadwaj stated that in-fact he does not know whether Sh. Dinesh has given him the pendrive to him or the department but it had been given by Sh. Deepak Kapoor stating that it will be produced in the court.
The counsel for the respondent stated that he had enquired from Sh. Dinesh, the inquiry officer through telephone and he had also given the password to open the pendrive. In these circumstances, let the inquiry officer Sh. Dinesh and Sh. Deepak Kapoor be called on the next date of hearing. The pen drive be kept in plastic cover having made a mark that it is allegedly given by the appellant establishment. List the matter on 08.10.2024.
