Pursuant to order dated 08.10.2025 passed by this Court, learned CJM Raibareli has sent a report/letter dated 14.11.2025 and according to the same the appellant nos. 1 to 3 namely Devi Shanker s/o Ram Kripal Singh, Durga Shanker s/o Ram Kripal and Ram Kripal Singh s/o Late Chandra Pal Singh, died on 08.08.2023, 20.06.2019 and 26.12.2013, respectively. The relevant portion of report/letter dated 14.11.2025 is extracted hereinunder:- "उपरोक्त विषयक वाद में माननीय उच्चच न्यायायालय, इलाहाबाद, खण्डडपीठ लखनऊ द्वाारा जारी आदेश पत्रांांक संख्याया 13883 दिनांक 31.10..2025 जरिये डाक दिनांक 03.11.2025 को प्रााप्तत हुआ. प्रााप्तत आदेश का अनुपालन कराये जाने हेतु अपीलान्टट सं1 देवी शंकर पुत्र राम कृपाल सिंह, अपीलान्टट सं.2 दुर्गा शंकर पुत्र राम कृपाल सिंह व अपीलान्टट सं.3 राम कृपाल सिंह पुत्र स्वव. चन्द्रपाल सिंह, निवासीगण ग्रााम शेषपुर समौधा, थाना बछरावां, जिला रायबरेली की Living Status Report हेतु प्रपत्र संबंधित थानाध्ययक्ष को प्रदत्त कराया गया। सम्बबन्धित थाने से आख्याया प्रााप्तत हुई कि अपीलान्टट सं1 देवी शंकर पुत्र राम कृपाल सिंह की मृत्युयु दिनांक 08.08.2023 में, अपीलान्टट सं.2 दुर्गा शंकर पुत्र राम कृपाल सिंह की मृत्युयु दिनांक 20.06.2019 में व अपीलान्टट सं.3 राम कृपाल सिंह पुत्र स्वव. चन्द्रपाल सिंह, की मृत्युयु दिनांक 26.12.2013 में हो चुकी है। जिसके सम्बबन्धध में उपनिरीक्षक ने ग्रााम प्रधान द्वाारा जारी मृत्युयु प्रमाण पत्र संलग्नन कर इस न्यायायालय में दाखिल किया व स्ववयं, ग्रााम प्रधान व मृतक के सम्बबन्धितों के बयान इस न्यायायालय के समक्ष अंकित करवाये हैं। तद्नुनुसार मृत्युयु प्रमाण पत्र तथा उपनिरीक्षक, ग्रााम प्रधान व मृतक के सम्बबन्धितों के बयान सहित अनुपालन आख्याया माननीय उच्चच न्यायायालय सादर प्रेेषित।" In view of aforesaid, the present appeal is dismissed as abated for the appellant nos.1 to 3 namely Devi Shanker s/o Ram Kripal Singh, Durga Shanker s/o Ram Kripal and Ram Kripal Singh s/o Late Chandra Pal Singh.
