HIGH COURT OF JUDICATURE AT ALLAHABAD LUCKNOW WRIT - C No. - 11236 of 2025 Court No. - 2 HON'BLE MRS. SANGEETA CHANDRA, J. HON'BLE AMITABH KUMAR RAI, J. Heard learned counsel for the petitioner and learned standing counsel for the State-respondents. This writ petition has been filed with the following prayers :-

(i) a writ, order or direction in the nature of certiorari quashing the impugned notice dated 19.08.2025 contained as Annexure No. 2 to this writ petition.

(ii) a writ, order or direction in the nature of mandamus commanding the opposite parties to organize a committee in the guidance of District Magistrate Amethi District Amethi. We have gone through the notice dated 19.08.2025 issued by respondent no.3, wherein it has been mentioned that certain interstate trade has been conducted by the petitioner, as is evident from the E-Mandi Portal and the pre-arrival slips of 1,285 vehicles carrying 4,04,326 quintals of corn and bajra. The mandi shulk has not been paid by the petitioner, nor has the development cess, totaling Rs. 1,48,58,980/-, thereby causing loss of revenue to the Mandi Samiti, Jafarganj, Amethi. Reference has been made to Section 17(3)(B) of the Mandi Adhiniyam, 1964 and the Food Processing Policy of 2023. The petitioner has been issued a notice to show cause and submit his explanation within seven days. In case of failure to show cause and submit the explanation as directed, necessary steps will be taken in this regard by respondent no.3 in pursuance of statutory provisions. Versus Counsel for Petitioner(s) : Naqibullah Khan, Prabha Avdesh Sahay Counsel for Respondent(s) : C.S.C. M/S Salwa Agro Hatcheries Private Limited Thru. Director Mahfooj Ahmad .....Petitioner(s) State Of U.P. Thru. Secy. Deptt. Of Agriculture Lko. And 2 Others .....Respondent(s)

Learned counsel for the petitioner has failed to establish, even prima facie, that the show cause notice has been issued without jurisdiction by respondent no.3. Ordinarily, the writ jurisdiction cannot be exercised only for challenging a show cause notice. Accordingly, the writ petition stands dismissed.
