1. We have heard learned counsel for the petitioners and Sri Akash Singh, learned counsel appearing for the opposite parties no. 1 to 3.

2. This petition has been filed with the following main prayers:- "I) Issue a writ order or direction in the nature of Mandamus commanding the respondent authorities to include and continue the names of the petitioners in the 'Electoral Rolls of 2026' based on their duely issued documents provided through the representation dated 31.10.2025 (Annexure No.7) being prepared under the scheme of 'Special Intensive Revision-2026' (for short 'S.I.R.-2026) II) Issue a writ order or direction in the nature of Mandamus thereby commanding the respondent no.2 & 3 to decide the representation dated 31.10.2025 contained as Annexure No.7 of the petitioner."

3. It is the case of the petitioners that they wish to contest the election of Village Panchayat – Terwachandpur, Block – Bilgram, Tehsil – Bilgram, Post – Ajmat Nagar, District – Hardoi. ‘Special Intensive Revision’ of Electoral Rolls is being carried out, and the Booth Level Officer is not accepting the papers submitted by the petitioners to show that they are the ordinary residents of Village/Kasba – Panhyoda of Gram Panchayat Terwachandpur, and they have also been orally informed that there were objections against the petitioners being included in the Electoral Rolls by some villagers, as a result whereof the petitioners’ names have been deleted.

4. Learned counsel appearing on behalf of opposite parties no. 1 to 3 says Versus Counsel for Petitioner(s) : Arvind Kumar, Arvind Kumar Verma, Ravi Kumar Verma Counsel for Respondent(s) : Aakash Singh Arvind Kumar Yadav And Another .....Petitioner(s) State Election Commissioner State Election Commission Lko. And 2 Others .....Respondent(s)

that the writ petition is premature, as no Special Intensive Review/Revision of Electoral Rolls is being undertaken as yet by the Election Commission of India. The State Election Commission has ordered a normal revision of Electoral Rolls as the election scheduled under the U.P. Panchayat Raj Adhiniyam, 1947 has been notified on 07.10.2025.

5. It has been submitted that the draft list of electors has not yet been published. In case the petitioners’ names do not find place in the draft list, then they have the remedy of filing an application in Form-4 under Rule 10 of the U.P. Panchayat Raj Registration of Electors Rules, 1994.

6. It has also been stated by Sri Akash Singh that in case the petitioners’ names are proposed to be deleted from the Electoral Rolls, they shall be issued a notice first under Rule 15.

7. Accordingly, the writ petition is disposed of with liberty to the petitioners to approach the appropriate authority under Form-4, in case their names are not included in the draft list.
