The petitioner herein filed O.S.No.61 of 2024 on the file of I Additional Junior Civil Judge Court, Bheemunipatnam for eviction of the defendants/respondents herein, to handover the vacant possession of the suit schedule property, to recover the arrears of rent and to restrain the defendants/respondents herein from subletting the schedule property to the 3rd party and for other consequential reliefs. The defendants filed their written statements in the said suit. The suit was being adjourned from time to time.
3. As per the contention of the learned counsel for the petitioner now the suit is posted for framing of issues and the petitioner filed an interlocutory application vide I.A.No.238 of 2026 under Order XV-A r/w.151 of Code of Civil Procedure, 1908 with a prayer to pass an order to deposit rental amounts into the account of the petitioner. Learned counsel submits that without filing counter in the said interlocutory application, the respondents are dragging the issue, which is causing unavoidable delay in proceeding further. The learned counsel for the petitioner further contends that the interlocutory application was filed in the month of January, 2024 and it is still pending as on today.
