IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to allow the petitioners herein to implead the Proposed Respondent No.2 i.e. Potluri Nirmala, W/o Rangaiah and/or pass IA NO: 2 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to permit the petitioner and 2nd Respondent to compromise the proceedings and consequently quash the entire proceedings in CRL.RC.No. 623 of 2010 and pass IA NO: 3 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased may be pleased to Record the compromise and consequently allow the Criminal Revision Case vide CRLRC No. 623 of 2010 pending before this Hon'ble Court and set aside the judgment dated 06-03-2010 in Criminal Appeal No. 40 Of 2009 passed by Hon'ble II Addl District and Sessions Judge, Ongole and pass Counsel for the Petitioner:

1. SHAIK EZDANI BASHA Counsel for the Respondents:

1. G RAJASREE

2. PUBLIC PROSECUTOR The Court made the following common order:

1. I.A. No.2 of 2026 is an application filed by the petitioner and the 2nd respondent seeking permission to compromise the matter.

2. I.A. No.3 of 2026 is an application filed to record the compromise entered into between the petitioner and the 2nd respondent and to set aside the impugned judgment.

3. Heard Sri Shaik Ezdani Basha, learned counsel for the petitioner, Sri Panini Somayaji, learned Assistant Public Prosecutor appearing for the 1st respondent/State and Ms. G. Rajasree, learned counsel for the 2nd respondent.

4. I.A. No.2 of 2026 contains a joint memo filed by both parties, i.e., the petitioner and the 2nd respondent. Their signatures have been duly attested by their respective learned counsel.

5. I.A. No.3 of

contains an affidavit filed by the petitioner/accused. Both learned counsels seek necessary orders for compounding the offence punishable under Section 498-A of I.P.C.

6. The petitioner and the de facto complainant, namely, Potluri Ramesh and Potluri Nirmala, are present before this Court. On being queried, the de facto complainant submits that she has signed the joint memo and understands the entire proceedings before this Court. She further submits that the dispute between her and the petitioner has been settled outside the Court. At this juncture, she has no objection if the petitioner is set at liberty in this case.

7. Heard the de facto complainant. It appears that she has voluntarily signed the joint memo and that there is no compulsion or coercion upon her to sign the same.

8. Instant criminal revision case has been preferred against the judgment dated 06.03.2010, passed in Crl.A.No.40 of 2009 by the Court of Sessions, Prakasam District, Ongole, partly confirming the judgment dated 27.09.2009, passed in S.C.No.244 of 2007 by the Assistant Sessions Judge, Kandukur. The petitioner, being aggrieved by the concurrent findings of learned Courts below, wherein and whereunder he was convicted for the offence punishable under Section 498-A of I.P.C., preferred the present revision.

9. During the pendency of the revision, a joint memo was filed and learned counsel for the petitioner seeks permission to compound the offence. The offence punishable under Section 498-A of I.P.C. is compoundable under section 320 of Cr.P.C. (A.P. State amendment) at the behest of the de facto complainant. Since the de facto complainant has no objection and has signed the joint memo before this Court, I find no legal impediment to pass an appropriate order.

10. Accordingly, in terms of I.A. Nos.2 and 3 of 2026, the offence punishable under Section 498-A of I.P.C. is hereby compounded. The conviction and sentence recorded against the petitioner by

learned trial court and confirmed by learned appellate court are hereby set aside. The petitioner be set at liberty, if not required in any other case. The sureties are also discharged.

11. Under the above observations, instant criminal revision case is disposed of.

12. Miscellaneous petitions, if any, pending in this criminal revision case shall stand closed. ____________________________ JUSTICE SUBHENDU SAMANTA Dt.14.10.2026 BV
