ORDER:

The Writ Petition is filed questioning the action of Respondent Nos. 2 and 3 in not considering the request of the Petitioner for his retirement on medical invalidation, as recommended by the Medical Board constituted under G.O.Ms.No.661, General Administration (SER.G) Department, dated 23.10.2008, as illegal and arbitrary.

2. The Petitioner was appointed as an Office Subordinate and joined the service on 27.07.1989 in the Office of the District Collector, Anantapur. While so, the health of the Petitioner deteriorated on account of chronic kidney disease and unable to render his service as an Office Subordinate. In that context, the Petitioner had applied for long leave on loss of pay, which was sanctioned on 21.02.2026, and in the said period, the Petitioner consulted specialist doctors for appropriate treatment. Taking note of the opinions given to the Petitioner, the Petitioner submitted an application to Respondent No. 2 on 09.03.2026 to refer his case to the Medical Board to certify his eligibility regarding retirement on medical invalidation. Pursuant thereto, the Petitioner was referred to the District Medical Board constituted in terms of G.O.Ms.No.661, General Administration (Ser.G) Department, dated 23.10.2008. After due examination by the Medical Board, a Report dated 14.07.2026 was issued recommending the case of the Petitioner for retirement on medical grounds. As no further action has been taken thereon by the Respondent Authorities, the present Writ Petition is filed.

3. The Learned Assistant Government Pleader submits that the case of the Petitioner will be examined by the Respondent Authorities, and the decision thereon will be communicated to the Petitioner.

4. Heard the learned counsel.

5. Considering the submissions made, the Writ Petition is disposed of at the stage of admission with the following directions:

i) The Respondents are directed to consider the case of the Petitioner for retirement on medical grounds in terms of the Report of the Medical Board dated 14.07.2026 within a period of six weeks from the date of receipt of a copy of this Order.

ii)

There shall be no order as to costs.

As a sequel, miscellaneous petitions pending, if any, shall stand closed.
