Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a Writ of Mandamus, appropriate Writ, Order or Direction declaring the action of the Respondents in terminating the services of the Petitioners vide proceedings dated 30.04.2025 as illegal, arbitrary and unconstitutional and set aside the same and direct the Respondent authorities to consider the representation of the Petitioners dt.-.07.2025 and 02.05.2026 to reinstate/continue the Petitioners in service with continuity and consequential benefits under APCOS and subsequently direct the Respondent authorities for appropriate relief, including regularization in accordance with law, having regard to their long and continuous service and the perennial nature of the work and to pass such other orders.

ORDER:
1. The present Writ Petition is filed questioning the action of Respondents in terminating the services of the Petitioners vide impugned Proceedings dated 30.04.2025, as illegal and arbitrary and consequently direct the Respondents to consider the representations submitted by the Petitioners.
2. The Petitioners were engaged as Security Guard Personnel in Dr. YSR Horticultural University, Venkataramannagudem Campus and in its various units. They were engaged during the period 2009 to 2016 through different outsourcing agencies from time to time. Though the outsourcing agencies changed, the Petitioners continued in the same post. While so, the Petitioners were brought under the Government- controlled outsourcing system known as Andhra Pradesh Corporation for Outsourced Services (for short “APCOS”) during the period 2019-2020 vide official proceedings including Memo No.10428/L, V&SC/2019-XXXI, dated 17.08.2020.
3. Pursuant thereto, the Petitioners were entrusted to APCOS w.e.f. 01.07.2020 and their wages were being paid through CFMS portal. Subsequently, the Petitioners were disengaged for want of certain financial concurrences. It is stated that the Petitioners are re-engaged by the Respondent-University through private outsourcing agencies. In that view, the Petitioners submitted several representations to the Respondent-authorities to re-engage them through APCOS.
4. Sri N. Bala Chandra Sekhar, learned Standing Counsel for Respondent No.4-University submits that the representations of the Petitioners would be examined and appropriate orders will be passed.
5. Recording the submissions, the Writ Petition is disposed of, at the stage of admission, with the consent of both sides’ counsels, as follows;
i) The Respondent-authorities are directed to consider the representations submitted by the Petitioners and pass appropriate orders thereon, as expeditiously as possible, preferably within a period of three (3) months from the date of receipt of a copy of this order.
ii) No order as to costs.
As a sequel, pending applications, if any, shall stand closed. __________________ NYAPATHY VIJAY, J
