ORDER:

The Writ Petition is filed questioning the action of the Respondents in not considering the case of the Petitioner for the post of Anganwadi Worker at 75 Veerapuram One Center, Gummagatta Mandal, ICDS Project, Rayadurgam, Ananthapur District, as illegal and arbitrary.

2. The Petitioner was appointed as Anganwadi Helper at the said centre in the year 2015 and has been discharging her duties. While so, on 31.01.2026, as the post of Anganwadi Worker in the said Anganwadi Centre fell vacant, the Petitioner, having the requisite qualification, is aspiring to be appointed in the said post. However, vide Proceedings dated 08.09.2026, the Joint Director (ICDS) had intimated the concerned that there is an opposition from the local villagers with regard to her appointment as Anganwadi Worker. Hence, the present Writ Petition.

3. Learned Assistant Government Pleader for Services would submit that the case of the Petitioner would be examined in terms of G.O.Ms.No.5 Department for Women, Children, Differently Abled and Senior Citizens (Prog.I), dated 13.03.2026.

4. Heard the learned counsels.

5. The reasoning given in the Proceedings by the Project Director on 08.09.2026 that the Villagers are opposing the appointment of the Petitioner as Anganwadi Worker appears to be not believable, as the Petitioner is working as Anganwadi Helper in the very same Anganwadi Centre for more than 11 years.

In the absence of any opposition in discharging the duties of the Petitioner as Anganwadi Helper, the observation that there is an opposition for appointment of Anganwadi Worker cannot be sustained.

6. Taking note of the submissions of the learned Assistant Government Pleader, the Writ Petition is disposed of with the following directions:

i) The Respondents are directed to consider the case of the Petitioner for appointment to the post of Anganwadi Worker in terms of G.O.Ms.No.5 Department for Women, Children, Differently Abled and Senior Citizens (Prog.I), dated 13.03.2026, without reference to the Letter of the Project Director, dated 08.09.2026.

ii) There shall be no order as to costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
