ORDER:
The Criminal Petition has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity, ‘the BNSS’) by the petitioners/accused Nos.1 to 9, seeking grant of pre-arrest bail in connection with Crime No.44 of 2026 of K.D.Peta Police Station, Anakapalli District, registered for the alleged offences punishable under Sections 118(1), 351(2), 79, 329(3) 115(2) read with 3(5) of Bharatiya Nyaya Sanhita, 2023 (for brevity, ‘the BNS’) and Sections 3(1)(r), 3(1)(s), 3(2)(va) of the Scheduled Castes and the Scheduled Tribes (Prevention of Atrocities) Act, 1989 (for brevity, ‘the SC/ST Act’).
2. Learned counsel for the petitioners/accused Nos.1 to 9 submits that a notice contemplated under Section 35(3) of ‘the BNSS’ was issued by the Investigating Officer. In view of the same, there is only apprehension of arrest against the petitioners/accused Nos.1 to 9.
3. Having regard to the facts and circumstances of the case, there are no merits in the present Criminal Petition.
4. In the result, the Criminal Petition is dismissed.
