OFFICE NOTE

1. 12.10.2026

MRK,J

I.A.No.1 of 2026

1. Heard.

2. Dispensed with. Crl.P.No.9119 of 2026

1. Heard learned counsel for the petitioners.

2. Learned Assistant Public Prosecutor takes notice on behalf of respondent No.1 and seeks time to get instructions.

3. Issue notice to respondent No.2.

4. Learned counsel for the petitioners is permitted to take out personal notice to respondent No.2 through Speed Post with acknowledgement due and file proof of service in the Registry.

5. Learned counsel for the petitioners submits that the 2nd respondent instituted a suit for specific performance, i.e., O.S.No.52 of 2023, on the file of the Principal District Judge, Sangareddy, arraying the petitioners herein as defendants, and that the said suit is pending adjudication before the competent Civil Court.

6. Learned counsel for the petitioners further submits that, despite the pendency of the civil suit before the competent Civil Court, the 2nd

2 respondent, by twisting the facts and giving the dispute a criminal colour, initiated the present criminal proceedings by way of a private complaint, which culminated in C.C.

7. Considering the facts and circumstances of the case, as the civil suit, i.e., O.S.No.52 of 2023, is pending adjudication between the petitioners and the 2nd respondent, and the allegations levelled in the criminal proceedings are predominantly civil in nature, matter requires consideration after hearing the 2nd respondent too in the light of the judgment in Anukul Singh v. State of Uttar Pradesh and Another1, there shall be an interim stay of all further proceedings in C.C.No.1320 of 2026 on the file of the Court of I Additional Chief Judicial Magistrate, Visakhapatnam, for a period of twelve weeks.
