O R D E R
The present Writ Petition is filed seeking the following relief:- “…to issue a Writ or direction preferably a Writ of Mandamus declaring the action of respondents in arbitrarily excluding petitioner’s name from the eligible list of beneficiaries for the One Time Settlement (OTS) Youth Package under the Rehabilitation and Resettlement (R&R) scheme for the Pula Subbaiah Veligonda Project, and their consequent failure to consider petitioner’s representation dated 10.08.2026, as illegal, arbitrary, unjust, discriminatory, and violative of Articles 14 and 21 of the Constitution of India and consequently direct the respondents to immediately include his name in the eligible list and disburse the One Time Settlement (OTS) Youth Package amount of Rs.12,50,000/- on part with his siblings who were granted the same vide R&R Award No.6/2020-21- 1, dated 02.2022 and pass such other order”.
2. Heard learned counsel for the petitioner and the learned Assistant Government Pleader for Irrigation.
3. In the present Writ Petition, the petitioner challenges the action of respondents in arbitrarily excluding petitioner’s name from the eligible list of beneficiaries for the One Time Settlement (OTS) Youth Package under the Rehabilitation and Resettlement (R&R) scheme for the Pula Subbaiah Veligonda Project, and their consequent failure to consider petitioner’s representation dated 10.08.2026, as illegal.
4. Though, several contentions are raised in the Writ affidavit, learned counsel for the petitioner limited his request to the extent of directing the respondent authorities to dispose of the representation dated 11.08.2026 submitted by the petitioner.
5. Learned Assistant Government Pleader for Irrigation submits that appropriate action would be taken on the representation dated 11.08.2026 submitted by the petitioner, pending with the respondent-authorities.
SRK, J WP No.25387 of 2026
6. In view of the submissions made by the learned Assistant Government Pleader, this Court is of the opinion that it is not necessary to adjudicate upon the truth or otherwise of the allegations made in the Writ Petition. This Court is conscious of the dictum laid down by the Hon'ble Apex Court in The Government of India v. P. Venkatesh 1 , wherein it was observed that directions merely requiring the consideration and disposal of representations should not be issued as a matter of course, as such orders, though facilitating the expeditious disposal of cases in overburdened adjudicatory institutions, do little to advance the cause of justice. However, the authorities are bound to act upon the representation submitted by the petitioner in accordance with law, within the time bound manner. Having regard to the fact that the learned counsel for the petitioner has himself confined the relief sought to a direction to the respondent authorities to consider and dispose of the representations dated 11.08.2026, this Court finds no other appropriate course, in the facts and circumstances of the case, except to issue such a direction.
7. Accordingly, instead of going into merits of the case, this Writ Petition is disposed of, directing the respondent authorities to dispose of the representation dated 11.08.2026 submitted by the petitioner, pending with them, in accordance with law, within a period of three (3) weeks, from the date of receipt of a copy of this order. There shall be no order as to costs.
As a sequel thereto, the miscellaneous applications, if any, pending in this Writ Petition, shall stand closed.
