JUDGMENT:
Learned counsel for the appellant seeks permission to withdraw the appeal. Learned counsel appearing for the respondents/claimants submits that, in view of the appellant’s request to withdraw the appeal, the respondents/claimants may be granted liberty to pursue an appeal, as they could not prefer an appeal earlier.
2. Learned counsel for the appellant places reliance on the judgment of a coordinate Bench of this Court in M.A.C.M.A. No. 751 of 2014. In that case, after considering the relevant provisions of law, the coordinate Bench permitted withdrawal of the appeal subject to payment of costs of Rs.5,000/-, together with interest at 6% per annum from the date of appearance of the claimants in the appeal until the date of deposit. It is needless to observe that, if the respondents/claimants have any grievance, they are at liberty to avail themselves of the appropriate remedies available to them in law.
3. Having considered the principle laid down by the coordinate Bench of this Court in M.A.C.M.A. No. 751 of 2014, this Court is of the considered view that the appellant may be permitted to withdraw the appeal, subject to payment of costs.
4. In the result, this Motor Accident Civil Miscellaneous Appeal is dismissed as withdrawn, subject to the appellant depositing costs of Rs.10,000/-, together with interest at 6% per annum from the date of appearance of the respondents/claimants in this appeal until the date of deposit before the Registry. Upon such deposit, respondent No. 1 shall be entitled to receive the said amount towards costs.
As a sequel thereto, pending miscellaneous petitions, if any, shall stand closed. ________________________ SUNITHA GANDHAM, J Dt:12.10.2026 Vns
