JUDGMENT: (Per Hon’ble Sri Justice D.Ramesh)

The intra-Court appeal is filed aggrieved by the order dated 21.7.2026 passed by the learned single Judge in W.P.No.19833 of 2026 wherein learned single Judge has considered the Writ Petition filed by the respondent herein and disposed of the same with the following direction.

4. Considering the submissions, the Writ Petition is disposed of with the following directions:

(i) The appellate authority i.e. Chairperson of Anantapur District Cooperative Central Bank Limited is directed to examine the appeal, dated 13.7.2017 filed by the petitioner and to dispose of the same, as expeditiously as possible, preferably within a period of three months from the date of receipt of a copy of this order.

(ii) No order as to costs.

2. Learned counsel for the appellants has mainly contended that without giving an opportunity to the appellants, learned single Judge has disposed of the Writ Petition at the stage of admission. In fact he has no grievance with regard to the directions issued by the learned single Judge but there is no record forthcoming with regard to pendency of the appeal filed by the petitioner as on 13.7.2017. He also disputed the seal which is affixed in the annexure P-1 dated 13.7.2017.

3. To support his contention he also relied on the representation made by the petitioner on 12.6.2024 wherein there is no reference with regard to the alleged appeal filed by the petitioner dated 12.6.2024.

4. Learned counsel for the respondent is also unable to place any material to show that the appeal is pending before the appellant.

5. Considering the submissions of the learned counsel for the appellants as well as learned counsel for the respondent as the Writ Petition was disposed of at the admission stage and there was no opportunity for the appellants to contest, the Writ Appeal is allowed setting aside the order impugned in this Writ Appeal by remanding the matter to the learned single Judge for fresh consideration. Liberty is also granted to the appellants herein to file counter-affidavit within a period of four (04) weeks. On filing such a counter-affidavit learned single Judge is requested to consider the matter based on merits and pass appropriate orders. No costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
