ORDER:

The Writ Petition is filed for the following relief:

“..to issue a Writ, order or direction, more particularly one in the nature of WRIT OF MANDAMUS declaring the action of 1 St Respondent in not taking any action against the proceedings F.No.20011/35/2024/coordination-NMC dated 12-02-2024 issued by the 2nd Respondent is illegal, arbitrary, colorable exercise of power and violation of Art 21 of the Constitution of India and consequently direct the 1st Respondent to take action against the proceedings F.No. 20011/35/2024/coordination-NMC dated 12-02-2024 issued by the 2nd Respondent and to pass…”

2. Heard Sri K. Ranga Srinivas, learned counsel representing Sri. A. Venkata Durga Rao, learned counsel for the petitioner and Sri.K.Varun Shyam Kumar, learned counsel for the respondent representing the learned Government Pleader for Services- IV.

3. The grievance of the petitioners is that respondent No.3 has not cleared their salary dues from the April 2020 to November 2020. Inspite of their repeated requests, they approached the authorities with personal representations. The respondent No.2 issued proceedings dated 12.02.2024, requesting respondent No.1 to take necessary action in the matter so as to redress their grievance under the intimation to the all concerned.

4. The grievance is regarding the non-payment of salary by respondent No.4 which is a private educational institute. Though the respondents have control under Section 79 of Education Act, respondents have some control over the private educational institutions against the removal of reduction of suspension. However the respondent No.2 has instructed the respondent No.1 to take necessary action for redressal of the grievances of the petitioner.

5. Now the petitioners seek a direction to the 1st respondent to look into their grievances and let the 1st respondent may take appropriate action as per law, after issuing the necessary notices and providing the opportunity to the petitioners and the 4th respondent college and to take appropriate action for redressal of the grievances of the petitioners.

6. Considering the said request, this Court deems it appropriate to dispose of the Writ Petition without expressing any opinion on the eligibility and entitlement of the Writ Petitions and without recording any findings on the merits of the matter.

7. Accordingly, Writ Petition is disposed of directing the 1st respondent to look into the grievances of the petitioners and take appropriate action as per law, after issuing notice and providing an opportunity of hearing to the petitioners as well as 4th respondent, within a period of (02) two months from the date of receipt of copy of this order.

Accordingly, this Writ Petition is disposed of.

8. Consequently, interim orders also shall stand vacated.
