ORDER:

1. The present Writ Petition is filed questioning the Proceedings No.231/A1/2026, dated 25.07.2026, discontinuing the Petitioner from further contractual engagement with immediate effect, as illegal and arbitrary.

2. The Petitioner was appointed as Centre Administrator under the control of the District Women and Child Welfare and Empowerment Officer, Prakasam District, on 04.12.2023, and has been discharging her duties to the best of her ability. While so, on 24.01.2026, the Petitioner sustained a serious injury to her left leg, resulting in severe damage to her left knee. Consequent to her injury, she underwent treatment at Kakumanu Hospital, Ongole, and availed medical leave from 28.01.2026 to 06.02.2026. Later, due to her medical condition, the Petitioner submitted an application seeking an extension of her medical leave.

3. While so, the Project Director and Senior Assistant informed the Petitioner that urgent budget utilization work was pending and that the continued absence of the Petitioner would adversely affect the official work of the Department. In view of the urgency, the Petitioner attended the office and discharged her duties. However, her medical condition deteriorated, requiring medical treatment at Hyderabad. The Petitioner had applied for Casual Leave on 13.07.2026 and 14.07.2026, and upon examination, the specialists at Apollo Hospital, Hyderabad, stated that there was a tear in the tendons of the Petitioner's left knee and advised her to undergo complete rest. In view of the said medical condition, as the Petitioner was unable to attend to her duties, her services were discontinued. Thereafter, the Petitioner submitted a representation to the District Collector, i.e., Respondent No.3, on 27.07.2026, seeking her reinstatement as Centre Administrator. However, as the same is not being considered, the present Writ Petition is filed.

4. Learned Assistant Government Pleader for Services submitted that the representation given by the Petitioner would be examined by the Respondent-Authorities and an appropriate decision would be communicated to her.

5. Heard Sri Pamarthy Rathnakar, learned counsel for the Petitioner as well as learned Assistant Government Pleader for Services.

6. Considering the submissions, with the consent of learned counsel appearing on both sides, this Writ Petition is disposed of at the admission stage, with the following directions:-

(i) The District Collector/Respondent No.3 shall consider the representation submitted by the Petitioner seeking continuance of her employment on contract basis, taking note of the medical report enclosed therewith, and communicate the decision to the Petitioner within a period of six weeks from the date of receipt of a copy of this order.

7. No order as to costs.

8. As a sequel, miscellaneous petitions, pending if any, shall stand closed. ________________________ JUSTICE NYAPATHY VIJAY
