JUDGMENT:

The present appeal was preferred by the appellant herein who is the defendant before the Trial Court challenging the impugned Judgment and Decree dated: 21.07.1995, in O.S.No. 101 of 1987 on the file of the Court of the learned Subordinate Judge, Gudur. Originally, the suit was filed by the wife and daughter, seeking maintenance.

2. Appellant herein was directed to pay of Rs.600/- per month to the wife and of Rs.300/- per month to the daughter towards maintenance. Aggrieved thereby, the defendant being the husband preferred this appeal. This matter was listed several times earlier but there was no representation on either side.

4. Today, when the matter is listed under the caption “Stayed Matters”, this matter is specially identified, since it is an old matter but either of the parties or counsel appeared before this Court.

5. At the time of admission, a Co-ordinate Bench of this Court vide order dated 05.02.1999 directed the appellant to pay an amount of Rs.400/- per month to the wife and of Rs.150/- per month to the daughter and continue to pay the same and in the meanwhile, stay of arrest of the appellant was also ordered. Neither the appellants nor the respondents are showing any interest to prosecute the matter.

6. In view of the above said facts and circumstances, the Appeal Suit is dismissed for default. There shall be no order as to costs. Interim orders, if any, deemed to have been vacated.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
