IN THE HIGH COURT OF ANDHRA PRADESH AT AMARAVATI
WRIT PETITION NO: 29062 of 2026 Bench Sr.No:-3
Aaryaansh Rao ...Petitioner Vs. The State of Andhra Pradesh and Others ...Respondent(s)
********** CORAM : THE CHIEF JUSTICE LISA GILL SRI JUSTICE CHALLA GUNARANJAN DATE : 9th October 2026 Present: Advocate for Petitioner: MEDIDA SUBBA RAO Advocate(s) for Respondent(s): GP FOR MEDICAL HEALTH, TATA VENKATA SRIDEVI
ORDER: (per Hon’ble Sri Justice Challa Gunaranjan)
Present writ petition is filed under Article 226 of the Constitution of India with the following prayer: “It is respectfully prayed that this Hon’ble Court may be pleased to
a) Issue a Writ, Order or Direction, more particularly one in the nature of Writ of Mandamus, declaring the action of the respondents in classifying the petitioner as APNL/Non-Local without duly considering the petitioner’s documented schooling history and the circumstances of his relocation on account of his mother’s official Central Government transfer, as arbitrary and violative of Article 14 of the Constitution of India,
b) Direct Respondent Nos.2 and 3 to reconsider the petitioner’s local-status claim in the light of his schooling history, his mother’s service and transfer particulars, his BSG eligibility and certificates, the Round-1 BSG allotment particulars and the other documentary material placed on record, in accordance with the applicable rules, prospectus and law;
c) Direct the respondents to pass a reasoned order on the petitioner’s claim and, if the petitioner is found eligible under the applicable framework, to treat his candidature accordingly for the purpose of consideration against the relevant local-area seats;
d) Pending such reconsideration, permit the petitioner to participate in the ongoing counselling process, subject to the applicable rules and the final outcome of the Writ Petition;”
2. Petitioner stated to have studied all through till completion of Class XI in State of Andhra Pradesh, and on account of transfer of his mother to Hyderabad due to employment, he completed Class XII at State of Telangana. Petitioner appeared for NEET-UG 2026 and secured 430 marks with an All India Rank of 2,05,363. It is stated that during the process of counselling undertaken by respondents 2 and 3, petitioner was treated as non-local and was not considered against local area seats in SV University local area, though substantial studies of petitioner were within the area falling under SV University. Thus aggrieved, present petition is filed.
3. Heard Sri Medida Subba Rao, learned counsel appearing for petitioner and learned Government Pleader for Medical and Health and Smt.T.V.Sridevi, learned standing counsel, appearing for respondents.
4. Learned counsel appearing for petitioner, by relying on the judgment of the Hon’ble Apex Court in case of Meenakshi Malik v. University of Delhi1, contended that in view of avocation of petitioner's mother being a teacher in Kendriya Vidyalaya, since petitioner had to attend Class XII at Hyderabad in the State of Telangana, he cannot be denied the status of local candidature within the State of Andhra Pradesh where entirety of his studies were pursued except for Class XII.
5. Smt.T.V.Sridevi, learned standing counsel for respondents 2 and 3, on the other hand, relied on judgment passed by this Court in Shaik Mubeen Sadia Parveen v. The State of Andhra 1 (1989) 3 SCC 112
Pradesh and others2 as well as the judgment of Division Bench of Telangana High Court in Jella Ankitha v. The State of Telangana3, against which appeal in SLP(c) No.33862 of 2026 was dismissed, to contend that the issue is no more res integra and unless petitioner satisfies the requirement of Para 4 of Presidential Order, he cannot be considered as local.
6. Having regard to aforesaid submissions and that this Court has already decided the very same issue in the judgment cited above, we do not find any merit in the writ petition. Accordingly, this writ petition dismissed. No costs.
As a sequel, miscellaneous petitions pending consideration, if any, in this case shall stand closed.
