ORDER:
1. This Civil Revision Petition has been preferred against the Order, dated 26.09.2019, in E.A.No.368 of 2019 in E.A.No.4 of 2017 in E.P.No.240 of 2016 in O.S.No. 86 of 1997 passed by the Principal Civil Judge (Senior Division), Visakhapatnam, which was an application filed under Order XXVI, Rules 9 and 10 read with Section 151 of the Civil Procedure Code for appointment of the Advocate Commissioner by the claimant and the said application was dismissed.
2. On 25.08.2026, there was no representation for both sides and the matter was adjourned to 11.09.2026, directing to be listed under the caption for dismissal. On 11.09.2026 also, there was no representation and the matter was adjourned directing to list under the caption “for dismissal for non-prosecution”.
3. Today also, there is no representation. The E.P., of the year 2006 is still pending in view of the Civil Revision Petition.
4. Since the petitioner is not prosecuting the case, the petition deserves dismissal for non-prosecution.
5. Accordingly, this Civil Revision Petition is dismissed for non- prosecution/default.
