The Court made the following order:

Heard Sri Gadipudi Venkateswarlu, learned counsel appearing for the petitioners, learned Assistant Government Pleader for Municipal Administration and Urban Development appearing for respondent No.1 and Sri Gudapati Lakshmi Narayana, learned Standing Counsel for Municipalities appearing for respondent No.3. With the consent of both the learned counsel, the Writ Petition is disposed of at the stage of admission.

2. The grievance of the petitioners in the instant Writ Petition is against the action of the 3rd respondent in interfering with the possession and enjoyment of the subject property, admeasuring 18 cents, situated in Survey No.143-1 of Melupatla Village, Ubedulla Compound (Extension), Punganur Town, Annamayya District.

3. It is contended that the petitioners are the absolute owners of the subject property. However, respondent Nos.3 and 4 are interfering with the construction activities undertaken by the petitioners at the instance of the unofficial respondents Nos.5 to 10 and have threatened to demolish the existing structure.

4. It is further submitted that the petitioners have submitted a representation dated 15.09.2026 before the 3rd respondent, alleging that the unofficial respondent Nos.5 to 10 are unauthorisedly laying a road across the petitioner’s land. The said representation is pending for consideration.

5. Learned counsel for the petitioner submits that without considering the said representation and passing appropriate orders, the respondent authorities are interfering with the petitioners' construction activities and threatening to demolish the structure, despite the petitioner’s lawful possession and ownership of the subject property.

6. Today, when the matter is taken up for consideration, Sri Gudapati Lakshmi Narayana, learned Standing Counsel for Municipalities has placed before the Court a copy of the written instructions received from respondent No.3. A perusal of the same would reflect that the petitioners have not obtained any permission for undertaking construction over the subject property. It is further stated that respondent No.3 has not demolished any construction. It is further stated that, if the petitioners have undertaken any construction without obtaining the requisite permission, any action proposed against the petitioner in the said regard shall be in accordance with law.

7. Having regard to the above, this Court deems it appropriate to dispose of the Writ Petition with a direction to respondent No.3 to consider and pass appropriate orders on the representation dated 15.09.2026 submitted by the petitioners, after affording an opportunity of hearing to the petitioners and all concerned parties, within a period of two months from the date of receipt of a copy of this order.

8. It is needless to observe that the respondent authorities shall not interfere with the possession of the petitioners over the subject property without following due process of law.

9. Pending consideration of the representation dated 15.09.2026, the respondent authorities are directed not to take any coercive action against the petitioners. The petitioners are at liberty to submit their objections before the concerned authorities.

10. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous applications pending, if any, shall stand closed. ______________________________ JUSTICE KIRANMAYEE MANDAVA Date: 09.10.2026 BSK
