ORDER:
1. This matter appears under the caption for orders.
2. The instant Criminal Revision case has been filed challenging the order of conviction and sentence passed against the petitioner, which was further confirmed by the appellate court, for the offence punishable under section 138 of the Negotiable Instruments Act, which was lodged by 2nd Respondent being de- facto complainant.
3. By filing a memo, dated 11.08.2026, the petitioner contended that the matter was settled between the petitioner and Respondent No.2/ de-facto complainant of this matter.
4. Learned Counsel for 2nd respondent/ de-facto complainant has no instructions on this point. Consequent thereto, this Court directed the State authority to enquire the matter and submit a report.
5. In pursuance of the said direction, dated 08.09.2026, Sub-Inspector of Police, Bantumilli police station, Krishna District, enquired the matter and placed a status report in respect of 2nd respondent/ de-facto complainant. He has also secured a statement of 2nd respondent in Telugu Vernacular, which reflects that presently there are no disputes between petitioner and 2nd respondent and

earlier dispute regarding cheque bounce case has already been settled by payment of money in the presence of village elders.
6. Offence under section138 of the Negotiable Instruments Act is compoundable under section147 of the Negotiable Instruments Act.
7. Since the matter was settled out of Court by making payment to the de-facto complainant by the petitioner, this court is of the view, it is necessary to pass appropriate order to dispose of the case.
8. Taking note of the memo filed by the petitioner on 11.08.2026 and the report filed by the State through Sub-Inspector of Police, Bantumilli police station, it appears that the offence against the present petitioner is required to be compounded, and hence, the same is compounded.
9. On the above observation, the order of conviction and sentence against the petitioner recorded by the learned trial court, affirmed by the learned appellate court is hereby set aside.
10. Accordingly, the Criminal Revision Case is disposed of.
11. Sureties of the petitioner/accused, if any, shall stand discharged.
As a sequel, pending miscellaneous applications, if any, shall stand closed. _________________________________ SRI JUSTICE SUBHENDU SAMANTA
