WRIT APPEAL Nos.1268 of 2025 & 953 of
Bench Sr.Nos:-11 & 11.1
W.A.Nos.1268 of 2025 & 953 of 2026:- L.P.Chape Charitable Society and another ...Appellants Vs. SVR College of Nursing and others ...Respondents ********** CORAM : THE CHIEF JUSTICE LISA GILL SRI JUSTICE CHALLA GUNARANJAN DATE : 8th October 2026 Present : Advocate for Appellants : Sri N. Subba Rao, learned Senior Counsel with Sri Kochiri Raja Shekar Advocates for Respondents : Sri Vijay Mathukumilli (R-1), Learned Government Pleader for Medical, Health and Family Welfare (R-2 & R-3), Smt. Tata Venkata Sridevi, learned Standing Counsel for Dr.N.T.R. University of Health Sciences (R-4). LISA GILL, CJ.
W.A. No.953 of 2026 has been filed challenging order dated 08.10.2025 passed in W.P.No.25267 of 2025 by learned Single Bench whereby writ petition filed by respondent No.1/writ petitioner was disposed of while setting aside impugned proceedings dated 11.09.2025 passed by respondent No.2 in the writ petition and matter was remanded to said respondent with a direction to pass appropriate orders within two (2) weeks from the date of receipt of order. W.A. No.1268 of 2025 has been filed for setting aside order dated
13.11.2025 passed by learned Single Bench whereby review application filed by present appellants, who were not impleaded as parties to writ petition, was dismissed. Both appeals are thus taken up together for hearing and adjudication.
2. Impugned order in writ petition was passed wherein writ petitioner was found ineligible to run B.Sc.(Nursing) course in absence of proper clinical facilities. This order was passed on the basis of complaint filed by present appellants who informed authorities that no student from writ petitioner’s college had ever attended Ameelio Hospital i.e., present appellant for clinical training.
3. Primary case set up by present appellants/review applicants was that without impleading them as party to writ petition, impugned order dated 08.10.2025 was passed whereas impugned proceedings dated 11.09.2025 had been passed on the basis of a complaint submitted by present appellants against the writ petitioners.
4. As of now, it is an admitted position that in compliance of order dated 08.10.2025, order dated 05.11.2025 was passed by respondent No.2 according conditional permission for academic year 2025-2026 to writ petitioner vide letter dated 05.10.2026. Renewal of recognition for two academic years 2026-2027 and 2027-2028 has also been accorded subject to condition of obtaining Government Order for parent hospital as per existing rules in force.
5. Learned counsel for appellants, at this stage, submits that only subsisting grievance of appellant is that due to clinical attachment of the writ petitioner with present writ appellants, appellant institution itself is unable to get permissions for its own Nursing Colleges whereas the facility available with appellant institutions is not being extended to writ petitioner.
6. Learned counsel for the writ petitioner submits that the facilities available for clinical attachment at the appellant, Ameelio Hospital, Kurnool, are not being used by writ petitioner. Writ petitioner is using the facility of Government Hospital, Kurnool. This is affirmed by learned counsel representing respondent Nos.2 and 3. Therefore present appeals, apart from being devoid of any merit are now rendered infructuous.
7. Keeping in view facts and circumstances as above, learned counsel for appellants does not deny that present appeals are rendered infructuous, same are disposed of accordingly. No order as to costs.
8. Photocopy of this order be placed on the file of aforementioned connected case.
Miscellaneous Petitions pending, if any, shall stand closed. LISA GILL, CJ
