O R D E R
The present Civil Revision Petition is filed, aggrieved by the non-disposal of Original Suit No.78 of 2021 pending on the file of the learned Junior Civil Judge, Kuppam, expeditiously.
2. Petitioner herein is the plaintiff, and respondent herein is the defendant, in O.S.No.78 of 2021 on the file of the trial Court. Parties hereinafter referred to, as they were arrayed before the trial Court.
3. Plaintiff filed O.S.No.78 of 2021 against the defendant pending on the file of the learned Junior Civil Judge, Kuppam, seeking the Court to pass a decree in his favour, granting Permanent Injunction restraining the defendant, her men and agents from interfering with the plaintiff’s peaceful possession and enjoyment of the suit schedule property.
4. Today when the matter has come up before this Court, learned counsel for the plaintiff would contend that the aforesaid suit was filed in the year 2021, and no progress has been made over these five years, and it amounts to gross delay without justifiable reasons. Learned counsel seeks an order to direct the trial Court to take up the aforesaid suit on priority basis and to dispose of, the same as expeditiously as possible.
SRK, J
5. This Court vide Order dated 10.07.2026 permitted the plaintiff to take out personal notice to the defendant. Again, on 07.08.2026, this Court permitted the plaintiff to take out fresh personal notice to the defendant. Since the notice on the defendant returned unserved with an endorsement ‘No such person’, this Court vide Order dated 03.09.2026 permitted the petitioner to take out personal notice to the learned counsel for the defendant appearing before the trial Court.
6. Heard the learned counsel for the petitioner/plaintiff.
7. A perusal of the material on record goes to show that the plaintiff filed O.S.No.78 of 2021 against the defendant seeking the relief of Permanent Injunction. The defendant filed written statement, and the trial Court framed the issues on 27.03.2025, and by the time of filing of the present Revision Petition, the said suit was pending for commencement of trial. Therefore, having regard to the facts and circumstances of the case, and also having regard to the submission made by the learned counsel for the plaintiff, this Court, without going into merits of the petition, directs the learned Junior Civil Judge, Kuppam to take up the suit in O.S.No.78 of 2021 pending on its file, on priority basis, and dispose of, the said suit on merits, expeditiously, in accordance with law, SRK, J
within a period of one (01) year from the date of receipt of a copy of this order.
8. Accordingly, the Civil Revision Petition is disposed of. There shall be no order as to costs of the CRP.
Consequently, miscellaneous applications pending if any, shall also stand closed.
JUSTICE K. SREENIVASA REDDY 8th October, 2026.
