1) The limited grievance of Petitioner is that the Order, dated 19.07.2024, passed by 3rd Respondent in R.C.No.2032/C2/2024, pursuant to the directions issued by this Court in W.P.No.10495 of 2024, is not in compliance with the said directions. In the said Writ Petition, this Court, vide Order dated 03.05.2024, directed Respondent Nos.2 and 3 to consider the representations of Petitioner, dated 19.07.2023, 20.08.2022 and 12.03.2021, and pass a speaking order in accordance with law, within a period of four (04) weeks from the date of communication of the said Order.

2) Pursuant thereto, 3rd Respondent passed the impugned Order, dated 19.07.2024. However, a perusal of the said Order does not disclose that any notice was issued to Petitioner or that an opportunity of hearing was afforded to him before passing the said Order.

3) Without expressing any opinion on the merits of the matter, this Court is of the considered view that the impugned Order, dated 19.07.2024, passed by 3rd Respondent is not in strict compliance with the directions issued by this Court in W.P.No.10495 of 2024, dated 03.05.2024.

4) In view of the above, the impugned Order, dated 19.07.2024, passed by 3rd Respondent in R.C.No.2032/C2/2024 is hereby set aside. The 3rd Respondent is directed to issue notice to Petitioner, afford him a reasonable opportunity of hearing and thereafter pass a fresh, reasoned and speaking order on the representations dated 19.07.2023, 20.08.2022 and 12.03.2021, strictly in accordance with law, within a period of two (02) months from the date of receipt of a copy of this Order.

5) Accordingly, the Writ Petition is disposed of. There shall be no order as to costs. As a sequel, miscellaneous petitions, pending if any, shall stand closed.
