1. Y SUDHAKAR Counsel for the Respondent(S):
1. GP FOR ROADS BUILDINGS
2. GP FOR REVENUE The Court made the following order:
The short grievance of the petitioner is that the respondents are attempting to demolish with the petitioner’s shop situated at Main Road, Opposite to vinayaka Temple, Kundram Village, Anakapalli Mandal and district contrary to law.
2. Heard Sri Y.Sudhakar learned counsel for the petitioner and Sri Venkata Satyanaryana, learned Assistant Government Pleader for Revenue Department.
3. Considering the facts and circumstances of the case, on 19.10.2023, this Court has granted interim orders which reads as follows: “The respondents are directed not to interfere with the petitioner’s property situated at Main Road, Opposite vinayaka Temple, Kundram Village, Anakapalli Mandal and district, pending further orders. However, this order does not preclude the authorities from taking steps in accordance with law.”
4. Though the matter is of the year 2023 and despite granting sufficient time, the respondents did not choose to file counter nor placed any instructions on record till date. In the said circumstances, instead of keeping the writ petition pending, by duly considering the interim order granted by this Court on 19.10.2023, this Court is inclined to dispose of the writ petition with the following direction:
“The respondent authorities are directed not to interfere with the subject property except under due process of law.”
Accordingly, the writ petition is disposed of. No costs.
Miscellaneous applications, pending if any, shall stand closed.
