The Court made the following order: Non-consideration of the petitioner’s representation dated 13.08.2026 is the grievance in the present Writ Petition.

2. Heard Sri Mulla Sohail Shareef, learned counsel for the petitioner and learned Assistant Government Pleader for Transport Department appearing for the respondents.

3. Learned counsel for the petitioner, in elaboration to what has been stated in the affidavit filed in support of the writ petition, contended that the petitioner purchased the vehicle bearing Registration No.NL 01 B 2907 in an auction conducted by Hinduja Leyland Finance Limited. He further submitted that, upon purchase of the said vehicle, the petitioner has been taking steps to regularize the vehicle by obtaining the transfer of ownership and removal of the hypothecation endorsement, after obtaining the requisite NOC/release documents from the Financier. However, the petitioner is unable to avail the statutory RTO services solely on account of a pre-existing challan dated 22.05.2025 which was raised much prior to the petitioner’s acquisition of the vehicle. He further submitted that the petitioner made a representation to respondent Nos. 3 and 4 on 13.08.2026 through DTDC post, but no action has been taken on the said representation till date. Hence, prayed to direct the respondents to consider the petitioner’s representation and pass appropriate orders thereon in accordance with G.O.Ms.No.285, Transport, Roads & Buildings (Tr-II), dated 15.09.1984.

4. On the other hand, learned Assistant Government Pleader for Transport Department submitted that the authorities would consider and pass orders on the petitioner’s representation in accordance with law.

5. Having regard to the facts and circumstances of the case, taking into consideration the submissions made by the learned counsel for the parties, and as the relief sought by the petitioner is innocuous and the authorities have intention to consider and pass orders on the petitioner’s representation, this Court, without expressing any opinion on the merits of the case, is inclined to dispose of the Writ Petition at the admission stage itself by passing the following order:

“The respondent authorities concerned are directed to consider and dispose of the petitioner’s representation dated 13.08.2026, in accordance with G.O.Ms.No.285 Transport, Roads & Buildings (Tr-II) dated 15.09.1984, after affording him an opportunity of personal hearing, if required, and pass appropriate orders within a period of four (4) weeks from the date of receipt of a copy of this order.”

6. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel thereto, interlocutory applications pending, if any in the Writ Petition, shall also stand closed. ____________________________ JUSTICE RAVI CHEEMALAPATI 22.09.2026
