ORDER:

The Writ Petition is filed questioning the action of the Respondent Nos. 3 and 4 in placing the Petitioner in the provisional general list as „not eligible‟ for selection to the post of Office Subordinate, Attender, Watchman, PH Worker and Kamati, pursuant to the Notification dated 29.03.2026 issued by the Respondent No.4 as illegal and arbitrary.

2. Heard the learned counsels.

3. A recruitment Notification was issued by Respondent No. 4 for appointment to the posts of Office Subordinate, Attender, Watchman, PH Worker, and Kamati on 29.03.2026, and the posts notified in the Notification were restricted only to individuals having Mental Disabilities classified as „MI/ATSM/SPLD/ID/MD‟. The Petitioner submitted his application for the said post on the strength of the Disability Certificate issued by the Medical Board, Government General Hospital, Nellore, on 09.05.2025, wherein it is mentioned that the Petitioner is suffering from a permanent disability of Mental Retardation (Moderate) and his IQ was assessed at 48. As Mental Retardation is not an identified disability for appointment to the posts notified in the Notification, the Petitioner was held to be ineligible vide impugned Proceedings dated 12.08.2026. Prior thereto, the Petitioner obtained a Disability Certificate issued by the Government General Hospital, Nellore, on 11.08.2026, and the nomenclature of the Disability Certificate was altered to “Intellectual Disability”, which is an acceptable disability for appointment under the notified posts.

4. As the Petitioner had submitted the “Intellectual Disability Certificate” issued by the Government General Hospital, Nellore, along with the representation dated 11.08.2026, the Writ Petition is disposed of with the following directions:

i) The Respondent Nos. 3 and 4 are directed to examine the representation of the Petitioner dated 11.08.2026 before filling up the vacancy so far as Nellore District is concerned.

ii) There shall be no order as to costs. As a sequel thereto, the miscellaneous petitions, if any, pending in this Petition shall stand closed.
