CRIMINAL PETITION No.1583 OF 2024 The Court made the following Order:

Instant Criminal Petition, under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of petitioner herein (A1), seeking to quash the proceedings in FIR in Crime No.45 of 2024 of Balajinagar Police Station, Nellore, SPSR Nellore District, for the offences punishable under Sections 120(B), 420, 467, 471, 477-A read with 34 of the Indian Penal Code, 1860.

2. Learned Assistant Public Prosecutor appearing on behalf of respondent-State on written instructions submits that the police referred the FIR in Crime No.45 of 2024 of Balajinagar Police Station, Nellore, SPSR Nellore District as “Mistake of Fact” vide C.No.6515/C1/2024, dated 29.07.2024.

3. Learned counsel for the petitioner also acceded to the submission made by learned Assistant Public Prosecutor.
