The Court made the following Order:
Instant Criminal Petition, under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the petitioner herein (A2), seeking to quash the proceedings in FIR in Crime No.140 of 2023 of Butchiyyapeta Police Station, Anakapalli District, for the offences punishable under Section 120b, 419, 420, 468, 471 read with 34 of the Indian Penal Code, 1860.
2. At the stage of admission, this Court has not granted any interim order in the instant lis.
3. Learned Assistant Public Prosecutor appearing on behalf of respondent-State on written instructions submits that the police referred the FIR in Crime No.140 of 2023 of Butchiyyapeta Police Station, Anakapalli District as “Civil in Nature” vide C.No.141/ Refer/SDPO-Akp/2026 dated 16.07.2026.
4. Learned counsel for the petitioner also acceded to the submission made by learned Assistant Public Prosecutor.
5. Accordingly, the Criminal Petition is closed. However, it is made clear that all the remedies are left open to the respective parties to proceed, in accordance with the law.
Interlocutory applications, if any, pending shall stand closed.
