1. GP FOR REVENUE
2. SIREESHA RANI VALLABHANENI SC For MUNICIPALITIES The Court made the following order:
The short grievance of the petitioners is that the respondents are trying to interfere and dispossess them from their subject properties situated in Taderu village, Bhimavaram Mandal, West Godavari district without following due process of law.
2. Heard Sri T.Sai Surya learned counsel for the petitioner and Sri Venkata Satyanaryana, learned Assistant Government Pleader for Revenue Department.
3. Considering the facts and circumstances of the case, on 23.06.2023, this Court has granted interim orders which reads as follows: “In the meanwhile, status quo with regard to the subject matter property existing as on today shall be maintained by both the parties in all aspects.”
4. Though the matter is of the year 2023 and despite granting sufficient time, the respondents did not choose to file counter nor placed any instructions on record till date. In the said circumstances, instead of keeping the writ petition pending, by duly considering the interim order granted by this Court on 23.06.2023, this Court is inclined to dispose of the writ petition with the following direction:
“The respondent authorities are directed not to interfere with the subject properties except under due process of law.”
Accordingly, the writ petition is disposed of. No costs.
Miscellaneous applications, pending if any, shall stand closed.
