The present appeal is filed aggrieved by the order dated 30.03.2012 passed in O.P.No.23 of 2007 by the learned Senior Civil Judge at Gudivada, wherein the Court below allowed the petition filed by the respondent/husband under Section 9 of the Hindu Marriage Act, 1955, seeking restitution of conjugal rights.
2. The Civil Miscellaneous Appeal is dismissed for non- prosecution granting liberty to the appellant to file a petition for restoration, if so desired. There shall be no order as to costs.
