CRIMINAL PETITION NO: 10704 of 2025 The Court made the following Order:

Instant Criminal Petition, under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, has been filed on behalf of the petitioners herein (A1 & A2), seeking to quash the proceedings in FIR in Crime No.108 of 2025 of Racherla Police Station, Prakasam District, for the offences punishable under Sections 316(2), 324(4) and 351(2) read with 3(5) of the Bhartiya Nyaya Sanhita, 2023.

2. No representation for the petitioners.

3. On the other hand, learned Assistant Public Prosecutor appearing on behalf of respondent-State, basing on the written instructions of the Station House Officer, Sub-Inspector of Police, Racherla Police Station, Markapuram District, submits that the Sub-Divisional Police Officer, Markapuram have referred the FIR in Crime No.108 of 2025 of Racherla Police Station, Prakasam District as “False” vide C.No.164/Refer/SDOM/2026 dated 17.05.2026.

4. Proceedings of Sub-Divisional Police Officer, Markapuram vide C.No.164/Refer/SDOM/2026 dated 17.05.2026 is made part of the record.

5. In view of the submission made by learned Assistant Public Prosecutor, the Criminal Petition is closed.
