Learned counsel for appellant submits that appellant had passed away since long and though he had taken time on 09.07.2024 to implead legal representatives of deceased appellant, he has been unable to contact them despite efforts; that neither have legal representatives of deceased appellant contacted him and that he has no instructions in this matter.

2. In view of the above, we have no option but to dismiss this writ appeal in default and for non-prosecution.

3. Writ Appeal is, accordingly, dismissed in default and for non-prosecution. Liberty is afforded to legal representatives of deceased appellant, if so advised, to file an appropriate application within four (4) weeks.
