O R D E R:

The Writ Petition is filed for the following relief:

“…to issue an appropriate writ, order or direction more particularly one in the nature of writ of Mandamus declaring the inaction of the respondent Nos.2 and 3 in not providing compassionate appointment to the petitioner, inspite of number of requests made by the petitioner to the respondent Nos.2 and 3 is arbitrary, contrary to the Article 21 and 300 A of the Constitution of India and contrary to the law as laid down by the Hon'ble Court and against the principles of natural justice and consequently direct to the respondent Nos.2 and 3 to provide the compensate employment without any delay and for the consequential relief of the petitioner, in the interest of justice…”

2. The case of the petitioner is that his father, Sagam Jaganmohan Reddy, died on 17.05.2021, while serving as an Assistant Executive Engineer at Mailavaram in the respondents department. Thereafter, petitioner, being the only son and a graduate in B.Tech (C.S.E.), submitted an application seeking appointment on compassionate grounds. The said application was forwarded to the Chairman and Managing Director, APCPDCL, Vijayawada, vide Lr.No.SE/O/VJA/PO/JAO.1/ADM.U3/D.No.3617/21, dated 07.12.2021 along with the requisite documents pertaining to the family members and the affidavits containing the consent of the other family members, as required by the respondent authorities.

3. Learned counsel for the petitioner submits that the petitioner’s application seeking appointment on compassionate grounds is pending consideration before the competent authority. He therefore seeks a direction to respondent No.2 to consider the petitioner’s claim in accordance with the applicable rules, and pass appropriate and reasoned orders thereon within a time frame to be stipulated by this Hon’ble Court.

4. Considering the submissions of the learned counsel for the petitioner, this court is of the view that no purpose would be served by keeping the writ petition pending. Accordingly, the Writ Petition is disposed of, directing respondent No.2 to consider the petitioner’s application for appointment on compassionate grounds and pass appropriate orders thereon, in accordance with the applicable rules, within a period of three months from the date of receipt of a copy of this order. No order as to costs.

Interim orders, if any, granted earlier shall stand vacated, and all pending miscellaneous petitions, if any, shall stand closed.
