Heard Sri Rambabu Koppineedi, learned counsel for the petitioners, learned Assistant Government Pleader for Fisheries and Sri Polisetty Radha Krishna, learned counsel appearing for the respondents.

2. The grievance of the petitioners in the instant writ petition is against the inaction of the respondents authorities in preventing illegal and unauthorized aquaculture farms/prawn tanks of the 17th and 18th respondents and inaction in preventing the pollution caused to the irrigation canals and the agricultural lands in R.S.No.400 to an extent of Ac.5.48 cents, R.S.No.399 to an extent of

Ac.20.56 cents, R.S.No.396 to an extent of Ac.20.28 cents, R.S.No.395 to an extent of Ac.19.89 cents, R.S.No.394 to an extent of Ac.19.58 cents, R.S.No.340 to an extent of Ac.9.88 cents, R.S.No.342 to an extent of Ac.3.90 cents, R.S.No.322 to an extent of Ac.3.15 cents, R.S.No.320 to an extent of Ac.6.80 cents totaling an extent of Ac.109.52 cents Situated at Lingaboinacherla Village, Narasapur Mandal, West Godavari District adjacent to the petitioners agricultural lands.

3. The 17th and 18th respondents filed their counter-affidavit, stating that the 17th respondent does not possess any land in respect of the subject extents claimed by the petitioner and that the 18th respondent has only got an extent of Ac.2.50 cents.

Having regard to the same, Sri Polisetty Radha Krishna, learned counsel appearing for respondent Nos.17 and 18, submits that they have not proposed to dig any fish ponds and that the land owned and possessed by the 18th respondent is used for agricultural operations. He further submits that there is no intention to dig fishponds in respect of the extent belonging to the 18th respondent. If any proposal to convert the subject extent of Ac.2.50 cents into fish ponds, such conversion would be undertaken only after obtaining the necessary permissions from the competent authorities and in accordance with law.

As the respondent No.18 has categorically stated that they have no intention of digging fish ponds in the subject lands, and in the light of the said submission made by the learned counsel appearing for respondent Nos.17 and 18, this Court is of the view that the grievance of the petitioner is resolved. Therefore, no further adjudication is necessary, in view of the submission that the respondent Nos.17 & 18 would obtain the licenses as provided under law and proceed further, if they intend to convert the agricultural land belonging to them into fish ponds.

6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
