The Court made the following Common Order:
Heard Sri Vijay Mathukumilli, learned counsel representing Sri Chaitanya Palisetty, learned counsel for the petitioner(s), learned Assistant Government Pleader for Education and Sri Venna Hemanth Kumar, learned Standing Counsel for NCTE appearing for therespondents.
2. It is stated by learned counsel appearing for the petitioners that the issue raised in the instant Writ Petitions is squarely covered by a judgment rendered by a Coordinate Bench of this Court in W.P.Nos.26846 of 2024 & batch, dated 27.10.2025, andrequests that the sameorder may be passed in these Writ Petitions also.
3. Sri Venna Hemanth Kumar, learned Standing Counsel for NCTE submits that there is an alternative remedy of appeal under Section 18 of the National Council for Teacher Education (NCTE) Act, 1993 (hereinafter referred to as ‘the Act’) against the orders impugned, without availing such a remedy the instant writ petitions are filed and hence the writ petitions are not maintainable.
4. Having regard to the submissions made, the Writ Petitions are allowedin terms of the order passed by this Court in W.P.No.26846 of 2024 & batch, dated 27.10.2025, and the impugned proceedings are set aside. However, the respondent authorities are at liberty to issue notices to the petitioner institutions, if any deficiencies are found, and to pass appropriate orders thereon after affording the petitioners due opportunity of hearing. There shall be no order as to costs.
5. Registry is directed to append a copy of the order passed by this court in W.P.Nos.26846 of 2024 & batch, dated 27.10.2025to this order.
