JUDGMENT:
When the matter was taken up for hearing, the learned counsel for the respondent submitted that the sole appellant passed away during the pendency of the appeal.
2. Learned counsel for the appellant represented that the appeal may be abated.
3. Considering the submissions made by the learned counsels, the appeal suit is dismissed as abated. There shall be no order as to costs.
