THE HONOURABLE SRI JUSTICE B.V.L.N.CHAKRAVARTHI APPEAL SUIT No.1260 of 2017 JUDGMENT: (Per Hon’ble Sri Justice B.V.L.N.Chakravarthi) Learned counsel for the appellant would submit that as per instructions received from the legal heirs of the appellant, the appellant died four years ago and the legal heirs are not willing to prosecute the appeal.

2. Learned counsel for the respondent also would submit that the appellant died four years back. Therefore, no application has been filed to bring the legal heirs on record in accordance with law. Hence, the appeal stands abated.

3. Considering the above submissions, we are of the opinion that since no steps have been taken as per law to bring the legal heirs of the deceased appellant on record, the appeal stands abated in accordance with law.
