Counsel for the Petitioner:

Sri Vijay Mathukumilli Counsel for the Respondent(S): GP for Higher Education The Court made the following order:

Heard Sri Sri Vijay Mathukumilli, learned counsel for the petitioner and learned Assistant Government Pleader for Higher Education appearing for the respondents.

2. The grievance of the petitioner in the instant Writ Petition is against the action of the respondent Nos.1 & 2 in not taking a final decision on the proposal submitted by the petitioner Institution for grant of NOC/permission for commencement of the technical courses, viz., Diploma in Artificial Intelligence and Diploma in Machine Learning, with intake of 120 seats, Computer Science & Engineering, with intake of 120 seats, Electronics and Communication Engineering, with intake of 60 seats and Electrical & Electronics Engineering, with intake of 60 seats, for the academic year 2026-27, despite the approval granted by the All India Council for Technical Education (AICTE) vide proceedings F. No. South-Central/1-46268386188/ 2026/ EOA dated 04.05.2026.

3. The petitioner is an educational institution established in 2009 imparting technical education. It is contended that for the academic year the petitioner has proposed for addition of additional diploma courses namely “Diploma in Artificial Intelligence and Diploma in Machine Learning” with an intake of 120 seats, “Computer Science & Engineering” with an intake of 120 seats, “Electronics and Communication Engineering” with an intake of 60 seats and

“Electrical & Electronics Engineering” with an intake of 60 seats. In the said regard, the petitioner sought permission from the All India Council for Technical Education (hereinafter referred as ‘AICTE’) being the appropriate authority vested with jurisdiction to grant NOCs. The applications were stated to have been submitted to both the AICTE and to the respondents. The AICTE granted extension of approval for the academic year 2026-27.

4. It is contended that the petitioner Institution has submitted an application for grant of NOC/permission dated 27.01.2026. On the basis of the said application, the inspection team conducted an inspection on 22.05.2026, submitted its report to the 2nd respondent on 25.05.2026, recommending to accord necessary permission for commencement of additional courses. The said report/recommendation was forwarded to the 1st respondent. It is contended that in respect of the said courses for the academic year 2026-27, the counseling is to be held from 29.06.2026 to 03.07.2026. Thus, the learned counsel for the petitioner contends that despite the due compliance of the statutory requirements and the reports of the inspection team the respondents have not granted the NOC. It is argued that the delay in considering the petitioner’s application would cause prejudice to the Institution. Having regard to the schedule fixed by the respondents for admissions and counseling, it is incumbent upon them to complete inspection, verification, if any pending and grant required permissions well before the counseling commences. However, the pendency of the application not only deprives the petitioner Institution, but also the students. Thus, it is argued that the respondents should have taken a decision on the application of the petitioner before any counseling commences.

5. Learned Assistant Government Pleader appearing for the respondent Nos.1 & 2 submits that the proposal relating to the petitioner Institution for commencement of the aforesaid Diploma courses is currently pending with the Government and that necessary orders would be issued upon completion of the process in accordance with law and the relevant guidelines.

6. Having regard to the same, as the AICTE has granted approval for commencement of the subject courses (new) and as the respondents herein have already conducted inspection and verification and did not find any shortcoming, this Court deems it appropriate to dispose of the Writ Petition directing the respondent Nos.1 & 2 to pass appropriate orders on the application filed by the petitioner seeking permission for commencement of new courses namely “Diploma in Artificial Intelligence and Diploma in Machine Learning”, “Computer Science & Engineering”, “Electronics and Communication Engineering”, and “Electrical & Electronics Engineering”. Pending consideration of the said proceedings as it is stated by the learned counsel for the petitioner that the counseling would be commenced from 29.06.2026 to 03.07.2026, this Court deems it appropriate to direct the respondents to allow the petitioner to participate in the counseling process in respect of the additional courses viz., “Diploma in Artificial Intelligence and Diploma in Machine Learning”, “Computer Science & Engineering”, “Electronics and Communication Engineering”, and “Electrical & Electronics

Engineering”, that is scheduled from 29.06.2026 to 03.07.2026 and allow intake of the students.

7. Needless to observe that the said intake of students to the said courses (new), would be subject to the proceedings of the respondent Nos.1 & 2 that would be passed on the application filed by the petitioner seeking permission/no objection for commencement of the subject courses i.e., “Diploma in Artificial Intelligence and Diploma in Machine Learning”, “Computer Science & Engineering”, “Electronics and Communication Engineering”, and “Electrical & Electronics Engineering”.

8. With the above observation, the Writ Petition is disposed of. There shall be no order as to costs.

As a sequel, miscellaneous petitions, if any, pending shall stand closed.
