JUDGMENT:
This appeal is preferred by the claimant/appellant seeking enhancement of the compensation awarded for the injuries sustained by him in the accident, aggrieved by the decree and order dated 30.08.2005 passed in O.P. No. 466 of 2001 on the file of the learned II Additional District Judge, Nellore.
2. Heard Sri Ch. C. Krishna Reddy, learned counsel for the appellant. Learned counsel for the appellant submits that the appellant is no more and that his legal representatives are not interested in prosecuting the matter. He therefore requests that the appeal be disposed of, as the legal representatives have not been brought on record.
3. In view of the above submission, the Motor Accident Civil Miscellaneous Appeal is dismissed as abated. In the circumstances of the case, there shall be no order as to costs.
As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
