ORDER:

1. The present Writ Petition is filed questioning the action of Respondent No.2 in not considering the case of the Petitioner to the post of Assistant Professor, Dentistry, pursuant to Notification No.02/2023, dated 14.07.2023, as illegal and arbitrary.

2. The Petitioner completed her degree in Bachelor of Dental Surgery in the month of August, 2014, and her Master's in Dental Surgery in the month of June, 2020. Thereafter, on 19.11.2020, the Petitioner had joined as a Senior Resident in the Dental Surgery department at Sri Balaji Medical College, Hospital, and Research Institute, Renigunta and Tirupathi.

3. It was submitted that the aforesaid Sri Balaji Medical College was initially under the management of Hitech Medical College and Hospital, Rourkela and accordingly, a certificate, dated 29.11.2021, was issued by the Principal of Hitech Medical College and Hospital, Rourkela to the Petitioner stating that the Petitioner had completed a one year period as Resident Specialist in the department of dental surgery at Rourkela i.e., from 24.11.2020 to 25.11.2021.

4. Thereafter, Sri Balaji Medical College got its own recognition and the Director of the said institution issued another certificate to the Petitioner on 17.07.2023 stating that the Petitioner had worked as a Senior Resident in the department of dentistry at Sri Balaji Medical College, Hospital and Research Institute from 24.11.2020 to 25.11.2021 at Tirupathi. It was on this ground, the case of the Petitioner is not being considered for the post of Assistant Professor, Dentistry under the impugned notification as certificates disclose different places of work as Senior Resident by the Petitioner for the same period. Hence, the present Writ Petition is filed.

5. Learned Assistant Government Pleader submitted that the Petitioner herself has produced two certificates issued for the same period with regard to her discharge of duties as Senior Resident. Therefore, there is a discrepancy with regard to the discharge of duties by the Petitioner as Senior Resident and hence is not being considered.

6. Heard the counsels.

7. As the discrepancy is only with regard to the correctness of the certificates produced by the Petitioner, this Writ Petition is disposed of, with the following directions: -

(i) .The Respondent-Authorities are directed to examine the explanation/representation, dated 08.06.2026 given by the Petitioner and to intimate their decision accordingly to the Petitioner.

(ii) . No order as to costs.

As a sequel, miscellaneous petitions, pending if any, shall standclosed. ________________________ JUSTICE NYAPATHY VIJAY
