ORDER: (Per Hon’ble Sri Justice D.Ramesh)
The present Family Court Appeal has been preferred challenging the judgment and decree dated 08.07.2009 passed by the learned Additional Family Court, Visakhapatnam, in I.A.No.143 of 2009 in O.P. No. 1084 of 2008.
2. When the matter is taken up for consideration learned counsel appearing for the appellant submitted that he has no instructions to proceed with the matter.
3. Considering the same, appeal is dismissed for non prosecution, if the counsel gets any instructions; he is at liberty to file recall application.
4. Accordingly, the appeal is dismissed for non prosecution. There shall be no order as to costs.
