ORDER:

The instant Criminal Revision Case is filed under Sections 438 and 442 of Bharatiya Nagarik Suraksha Sanhita, 2023 (for short ‘BNSS’) against the Order dated 31.03.2026 in CrI.M.P.No181 of 2026 in SC ST SC No.21 of 2020 passed by the learned Special Judge for trial of offences under SCs & STs (PoA) Act-cum-IV Additional District and Sessions Judge, Vizianagaram

2. Heard Ms.Sravan Kumar Naidana, learned counsel for the Petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor on behalf of the State is in attendance.

3. The revision petitioner in CrI.M.P.No181 of 2026 sought addition of charge under Section 354 IPC and relevant provisions of the SC/ST (POA) Act by invoking Section 216 Cr.P.C., contending that the evidence of P.W.1 disclosed an intention on the part of the accused to outrage her modesty. The trial Court, upon appreciation of the evidence of P.Ws.1 to 6, found that there was no material to establish the essential ingredients of Section 354 IPC, particularly the intention to outrage the modesty of P.W.1, and accordingly dismissed the petition.

4. Having considered the submissions made and upon perusal of the impugned order and material available on record, this Court finds no illegality or irregularity in the order passed by the learned trial Judge warranting interference in revisional jurisdiction.

5. Accordingly, the Criminal Revision Case is disposed of confirming the order dated 31.03.2026 passed in Crl.M.P.No.181 of 2026 in SC ST SC No.21 of 2020. However, the learned trial Judge is directed to dispose of the main case expeditiously, without being influenced by any observations made in this order.

Pending miscellaneous petitions, if any, shall stand closed. ________________________________________ Dr.JUSTICE VENKATA JYOTHIRMAI PRATAPA Date:07.05.2026 KKV
