ORDER:

The instant petition under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 has been filed seeking to grant anticipatory bail to the Petitioners/ Accused Nos.1 and 2, in connection with Crime No.193 of 2025

on the file of Karapa Police Station, which is registered for the offences under Sections 316(5), 318(4) r/w.3(5) of Bharatiya Nyaya Sanhita, 2023.

2. The case of the prosecution, in brief, is that:

The petitioners along with others have misappropriated loan repayment amounts as well savings amounts to a tune of Rs.99,96,440/- pertaining to members of 74 self-help groups of Kurada-1, Kurada-2 and Chinnamamidada village of Karapa Mandal, Kakinada District by issuing fake receipts to the said members of the groups without any remittance of amounts to the concerned banks. Basing on report of Project Director, DRDA-SERP, Kakinada, on 25.10.2025, registered a case in Cr.No.193 of 2025 of Karapa Police Station against the petitioners and others.

3. Heard Sri A.S.Narayana, learned counsel for the Petitioners and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor for State / Respondent.

4. Learned counsel for the Petitioner would submit that the Petitioners did not commit any offence and they are innocent. He further submits that there are no specific overt-acts against the petitioners in the report given to police. It is contended that they have fixed residence, and there is no possibility of absconding or tampering with evidence. It is further submitted that substantial part of investigation is already completed. Hence, prayed to grant anticipatory bail to the Petitioners.

5. Learned Assistant Public Prosecutor would submit that there are specific allegations against the Petitioners and there is misappropriation of huge public money by conspiring with other officials. It is further submitted that the Petitioners are absconding and their custodial interrogation is necessary to find out the full facts of the case. Hence, prayed for dismissal of the petition.

6. Though the learned counsel for the Petitioners contends that they are innocent and has been falsely implicated, it is seen that there are specific allegations against them and their involvement has come to light during the course of investigation. Further, there is misappropriation of huge public money by issuing fake receipts, which requires effective investigation of the case. In such circumstances, this Court is of the considered opinion that it is not a fit case to grant anticipatory bail.

7. In the result, the Criminal Petition is dismissed.

As a sequel thereto, miscellaneous petitions pending, if any, shall stand closed.
